What does this mean? All PBO’s/N.G.O.’s and Non-Profit Organizations, including Article 21 Companies, Non Profit Trusts, Associations of Persons; whether or not they were exempted from the payment of income tax are required to register for income tax purposes and apply for exemption. (Some organizations where registered in the past either with the SARS or for Fundraising approval, but NOT for both.) THIS IS THE REASON WHY SOME ORGANISATIONS IS EFFECTIVE IN RUNNING THEIR PROJECTS AND OTHERS NOT! Application is for exemption from income tax, donations tax, estate duty, stamp duty, transfer duty and approval for donations to be tax deductible in terms of section 18A of the Income Tax Act. (Section 18A approved organizations: Organisations conducting approved PBAs). A PBO which has been approved in terms of section 30 of the Act or an entity which is exempt in terms of section 10(1)(cA)(i) of the Act (having been approved by the Commissioner), and which carries on any approved PBA as set out in Part II of the Ninth Schedule (See Annexure C), may apply for Section 18A status in respect of donations received which are utilized for Section 18A approved PBAs.
The activities, which qualify for Section 18A approval, must be carried on in South Africa. SECTION 18 EXEMPTION means: An individual can give 10% or R1000 which-ever is the most of taxable income, and a company 10% of taxable income to a non-profit organization registered with the SARS for section 18A, as well as for Funding certificate, to receive tax deduction benefits. NB: According to new lottery act above organizations must also register with NPO Directorate and receive a certificate of approval, to raise funds from abroad, and the local public, companies, and to receive funds from the government and the lottery.
